Acceptable Use and Accessibility Policy

The Crown Property Centre of Expertise web portal (the CPCoE portal) is an internet portal, the purpose of which is to notify and list Crown – owned properties for other public entities.  The CPCoE portal is a cloud-based application that enables secure information sharing.

The CPCoE portal is available to authorised users to use in compliance with this Acceptable Use and accessibility Policy. By using or registering to use the CPCoE portal you will have accepted these terms and conditions. Breach of this policy may result in LINZ suspending or terminating your use of and access to the CPCoE portal site.

 

Accessibility

LINZ manages the CPCoE portal and site with accessibility in mind, and follows New Zealand Government Web Standards wherever possible, along with the World Wide Web Consortium's Accessibility Initiative (link is external).

Communicating with users

LINZ will from time to time send e-mails to authorised users. By registering you agree to the receipt of e-mails.

 

Your obligations to LINZ

You shall be solely responsible for maintaining appropriate security measures to assure that user identifications and passwords are kept confidential and are used only by the individuals to whom such user identifications and passwords have been issued.

You shall be responsible for providing, operating and maintaining the equipment, facilities, software, services and testing required  for using and accessing the Internet in order to use and communicate with the CPCoE  portal. This shall be at your own cost.

Your use of the CPCoE portal is limited to searching and viewing property data “as is” and submitting property information updates and notes in the available fields. You may use the system in accordance with the User Quick guide. You may not extract, harvest or scrape datasets from the CPCOE portal.

 

User Content as provided by public entities

You are responsible for the accuracy and completeness of all information provided or submitted by you when registering for or using the CPCoE portal.

LINZ has no responsibility for the accuracy, veracity and completeness of information, transmitted, or transferred, by you (as an external user) to the portal, nor for any errors in the manner of its input.

You may not add any information to the system which is frivolous or otherwise inappropriate.

When updating, editing or removing property information from the CPCoE site you must provide true and accurate information at all times. It shall your responsibility to keep your information up to date.

You must report inaccurate content on the CPCoE Web Portal site to LINZ promptly and must undertake to correct that information (if such information was provided by you in the first place).

You shall be fully liable for any consequences that may arise from the use of this information in any manner whatsoever and that LINZ shall not in any manner whatsoever be liable for the same.

 

User Content as provided by contractors working for LINZ

All information and data submitted into the CPCoE portal must be accurate, reliable and submitted in accordance with the highest standards as set out in your contract with LINZ.

You are responsible for the accuracy and completeness of all information provided or submitted by you when registering for or using the CPCoE portal.

You may not add any information to the system which is frivolous or otherwise inappropriate.

LINZ’s Obligations to You

In consideration of you entering into this agreement LINZ shall:

• Use reasonable endeavours to maintain the CPCoE portal in good operational condition; and
• Assist you to understand the operational requirements for the use of the CPCoE  Portal.

 

Our Obligations to Each Other

You and LINZ shall co-operate and assist each other in the performance of our respective obligations under these terms and conditions and bring to each other’s attention any concerns or difficulties experienced with the use of the CPCoE portal with the intent being to identify areas of improvement.

 

LINZ’s Liability

Notwithstanding anything to the contrary, you agree that LINZ shall not be liable for any damages, losses, liabilities, costs or expenses arising from any use whatsoever of any information or data held on the CPCoE Portal, or on any linked website, or arising from:

• Any exercise of any right, remedy or discretion which LINZ is entitled to exercise;
• Anything for which you accept responsibility or liability under these terms and conditions;
• Loss or corruption of your data or records or loss or corruption to your computing resources, software, or other information technology infrastructure;
• Any indirect, special, consequential, incidental, reliance or punitive damages, losses, liabilities, costs or expenses;
• Loss of revenue, loss of business or business opportunities, profits, anticipated savings, reputation or goodwill;
• Any interference with or damage to your computer system, software or data
• Any act or failure to act if the act or omission arises from any cause beyond its control.

 

Disclaimer
LINZ will use reasonable efforts to ensure that the information and data provided by LINZ on the CPCoE web Portal site is accurate and that the Portal itself is operational. However, because it is an electronic medium and interaction with it involves remote servers and the public internet, LINZ must make the following disclaimers:

• LINZ gives no warranty either express or implied in relation to the material or information held  the CPCoE web portal site or on any linked site, including its accuracy, reliability and suitability and accepts no liability whatsoever in relation to any loss, damage or other costs relating to the use of any material on this website or on any linked website or any compilations, derivative works or modifications of the material on this website or on any linked website;
• Third party material available on this website does not necessarily represent the views of LINZ;
• LINZ does not accept responsibility for any errors in transmission or downloading documentation from or to the CPCoE portal;
• LINZ does not accept responsibility for any misuse or loss of use, of data, errors, omissions, misstatements or misrepresentations concerning (whether express or implied) any such information or loss of profits arising out of or in connection with the use of this Web Portal due to any deliberate or negligent conduct on your part.
• LINZ shall not be liable for any delays, interruptions, errors or failures in the provision of the portal services. LINZ shall not be liable, either in contract or in tort, for any direct, incidental, consequential, indirect or punitive damages or any other losses, costs or expenses of any kind claimed to have arisen as a result of using the CPCoE portal or as a result of the non-availability, non-functioning or malfunctioning of the portal services or otherwise in connection therewith.

 

Security

While all reasonable security precautions have been taken by LINZ, including the provision of a secure and robust operating environment, the nature of communication by the Internet is such that LINZ cannot absolutely guarantee the privacy or confidentiality of communications transmitted via the Internet from interference by third parties.

Disclosure

Except as otherwise stated, LINZ may use information you provide via the CPCoE Portal, to improve the content, to customize the CPCoE portal to your preference, to communicate information to you (if you have requested it) and for LINZ’s  internal use. 

LINZ shall use the information you provide via the CPCoE portal to fulfil its obligations to manage and dispose of Crown Land in accordance with LINZ’s business objectives as well as LINZ’s statutory and legal obligations.
